iBET Packs Terms of Service
How Packs work, what a card is, how a sell-back pays, and what you agree to when you open your first pack. These terms are in addition to our Terms of Service.
1. What these Packs Terms are
iBET Packs ("Packs") is a feature of the Services operated by iBET Networks, LLC, a California limited liability company ("iBET Networks", "we", "us"). These Packs Terms govern your purchase and opening of Packs and what you do with the cards they reveal. They are in addition to our Terms of Service (the "Terms"), which are incorporated by reference, including Section 23 (Dispute Resolution, Arbitration, and Class Action Waiver) and Section 27 (Governing Law). Where these Packs Terms and the Terms differ on a matter concerning Packs, these Packs Terms control. By tapping "I agree", buying a Pack, or opening a Pack you accept these Packs Terms.
2. Eligibility
You may buy and open Packs only if you (a) hold an Account in good standing that has passed our identity verification, (b) are at least eighteen (18) years of age, or the higher minimum age of the state you are in (twenty-one (21) in Massachusetts), and (c) are physically located in an Eligible Jurisdiction at the time of purchase, as determined by our location service. The Eligible Jurisdictions for Packs are the states listed at www.ibetnetworks.com/where-you-can-play/. One person, one Account: Packs bought or opened through a second Account, or an Account opened for another person, may be voided under Section 11.
3. How Packs work
3.1. A Pack is sold at a fixed price (for example $1.00 or $5.00) for one category (football, baseball, basketball, hockey, Pokémon). Opening a Pack reveals exactly one card (a "Card").
3.2. Before you buy, the Pack screen shows "What's inside": the value bands a Card can fall into, the probability of each band, and the chance of the top ("Grail") band expressed as 1 in N. These are the odds used to decide your Card. They may change for Packs sold after a change; they never change for a Pack you have already bought.
3.3. The band is decided by a random draw at the moment of purchase, then a Card within that band is drawn from the catalogue for that category. Each draw is independent of every other draw and of anything you have bought or opened before. We keep a record of every draw, including the random values used, so any Pack can be checked against the odds it was sold under.
3.4. If, for a band drawn, no Card is available in the catalogue at that moment, the Card is drawn from the next lower band and the Pack record shows both. A Pack that cannot be filled at all is not sold and you are not charged.
3.5. The "Value" of a Card is the amount shown with it when it is revealed. It is fixed at that moment and is the amount a Sell-Back pays under Section 6. In the lowest band of a Pack, a Card whose market estimate is below that band is revealed at a Value inside the band, chosen at random; the Value shown is the Value paid.
4. Buying a Pack
4.1. Packs are bought with the cash balance of your Account only. Promotional balance, entry tokens and any other credit cannot buy a Pack.
4.2. A purchase is complete when you confirm it in the App. All Pack purchases are final and non-refundable except as provided in Section 11 or as required by law.
4.3. We may limit how many Packs an Account may buy in a day or in total, decline a purchase, or close Packs to an Account, in our discretion, including under Section 19 of the Terms (Responsible Gaming).
5. Cards
5.1. A Card is a digital item: a picture of a trading card and a Value, held in your Account. Opening a Pack does not transfer ownership of any physical trading card to you, and a Card has no use or value outside the Services other than a Sell-Back under Section 6 and, where offered, shipping under Section 5.3.
5.2. After a reveal you choose, for each Card, to Sell Back (Section 6) or to Keep it in your Locker. A Card in your Locker may be Sold Back later.
5.3. Some Cards may correspond to a physical trading card held by iBET Networks. Where the App marks a Card as shippable, you may ask for the physical card to be shipped to a United States address, subject to identity and address confirmation, any shipping charge shown in the App, and applicable law. A Card that has been shipped can no longer be Sold Back. Title passes on delivery. Physical cards are shipped as they are; we make no promise about their condition or grade beyond what the App shows.
5.4. Cards are not transferable between Accounts and cannot be sold, traded or given to another person through the Services.
6. Sell-Back
6.1. You may Sell Back any Card you hold to iBET Networks at any time while Packs is offered. A Sell-Back pays one hundred percent (100%) of the Card's Value to the cash balance of your Account at once, and the Card leaves your Account.
6.2. The Value of a Card does not change after its reveal. A Card you Keep and Sell Back later pays the Value shown at its reveal.
6.3. Cash from a Sell-Back is part of your cash balance and is subject to the Terms, including Section 9.6 (Withdrawals) and its play-through rule, Section 9.9 (Taxation) and Section 17 (Term and Termination).
6.4. A Sell-Back is final once confirmed.
7. Free Packs
7.1. We may grant free Packs to an Account, for example on sign-up or as a launch or promotional gift. A free Pack is opened the same way as a bought one, under the same odds, and its Card may be Kept or Sold Back the same way.
7.2. Free Packs expire on the date shown with them (ordinarily thirty (30) days after they are granted), are for the Account they were granted to, and cannot be transferred, exchanged or paid out other than by opening them.
7.3. Free Packs are a promotion under the Terms. Cash from a Card revealed by a free Pack is subject to Section 9.6 of the Terms, including the requirement of a played-through Deposit before withdrawal, and to Section 11 below. We may withdraw a free-Pack offer at any time for Packs not yet opened.
8. Values, odds and estimates
8.1. Card Values are set by iBET Networks from third-party market data (recent sales and listings of the corresponding trading cards) together with our own adjustments, and are updated regularly. A Value is the amount we will pay for the Card on a Sell-Back; it is not an offer to buy or sell any physical card, not an appraisal, not a guarantee of any resale price, and not financial, investment or collecting advice. The Value you see at a reveal may differ from the price the same trading card is listed or sold for elsewhere.
8.2. The odds shown for a Pack are the odds that decide the band. Within a band, which Card you receive depends on the catalogue at that moment and a second random draw; Cards nearer the lower end of a band are more likely than Cards nearer the top.
8.3. We may change the odds, bands, prices, categories or catalogue for Packs offered in the future, and may withdraw a Pack from sale, at any time. Changes never apply to a Pack already bought.
9. Responsible play
Packs are a form of play with real money. The responsible gaming tools in your Account (deposit, spend and time limits, cool-off and self-exclusion) apply to Packs. If you self-exclude, Packs closes to you with the rest of the Services. If you think you may have a problem with gambling, call 1-800-GAMBLER or text 800GAM to 53342. See our Responsible Gaming page.
10. Taxes
Section 9.9 of the Terms applies. Cash you receive from Sell-Backs may be reportable income; you are responsible for your own taxes, and we may ask for the information Section 9.9 describes before paying out.
11. Errors, misuse, and our right to void
We may void a Pack purchase, a reveal, a Card or a Sell-Back, reverse the related balance movements, and close Packs to an Account, where (a) a Pack was sold, or a Value or odds were shown, in error (including an error in the market data a Value was derived from), (b) a draw or payout was affected by a technical fault, (c) an Account was used in breach of the Terms or these Packs Terms, including the use of more than one Account, an Account opened for another person, automation, or the abuse of a free-Pack offer, or (d) we are required to by law or by a regulator. Where we void a bought Pack under (a) or (b) we return its price to your cash balance. We will tell you when we do any of this, by the email on your Account.
12. Intellectual property and third parties
The Card images, the Pack designs, the band names and the Packs feature are owned by or licensed to iBET Networks and are covered by Section 20 of the Terms. Trading card manufacturers and licensors (including Topps, Panini, Upper Deck, Fanatics and The Pokémon Company) and the players, teams and leagues shown on cards are not sponsors of, and are not affiliated with, Packs or iBET Networks. Market data is supplied by third parties and used under licence.
13. Availability and ending Packs
Packs is offered at our discretion and may be paused, changed or ended at any time. If we end Packs, Cards remaining in Lockers will be Sold Back automatically at their Value, after which they are removed.
14. Changes to these Packs Terms
We may revise these Packs Terms. The App will ask you to agree to a revised version before your next Pack. Packs bought before a revision are governed by the version you agreed to when you bought them.
15. Disputes
Any dispute about Packs is a dispute under the Terms and is governed by Section 23 of the Terms (Dispute Resolution, Arbitration, and Class Action Waiver), including its informal resolution step, and by Section 27 (Governing Law).
